Terms of Service

I [the artist] reserve the right to:

post, show, and display any and all images related to the commissioned work including but not limited to WIPs (work in progresses), sketches, revisions, and the finished artworks themselves. Exceptions may be made, but not guaranteed, at the request of the client.

refuse any commission request.

cancel a project at any time.

refuse service and/or cancel a commission if any of my terms are violated.

All purchases are for digital goods and no physical items will be mailed nor shipped.

I offer various services including, but not limited to, character/creature/item concept art, prop design, illustrations, and design sheets. I can also do environments and backgrounds, although they are not my forte.

Typically, I work at 300 DPI, but the client is responsible for communicating any file specifications they need, such as the dimensions and resolution of the image.

The client may provide input, feedback, and request changes at any time within reason.

No major changes beyond what’s reasonable shall be made without additional fees. These fees will vary in cost depending on the amount of work needed to redo/change the artwork.

Time spent on each commission, from when I begin working on them, will vary depending on complexity. May range from a few weeks to a few months.

Under no circumstances are chargebacks tolerated, and you agree to not attempt one.

If you are extremely rude and/or unpleasant at any point during the process, I have the right to discontinue the commission immediately.

File transfer for the images will be made through WeTransfer, and you will receive a link to download them through email.

Commissions are individually priced (in CAD) on a commission-to-commission basis, and prices will vary a lot depending on various factors. Please feel free to preemptively ask me about the price for your specific project, even if you aren’t committed to commissioning me.

The client is responsible for payment conversions. If you use another currency, please make sure to pay the correct amount.

I only accept payments through paypal, and clients must provide their email in order to receive an invoice.

Payments are made 100% upfront and I will not begin working until I have received the agreed sum.

Please do not send any kind of payment until I have confirmed that I can accept your commission and have asked to receive the agreed sum.

If the commissioned work is intended for commercial use/promotional purposes or is used to make money in other ways, there will be an additional cost.

Refunds may be given if:

I am still working on the sketches. When the work goes beyond that point, refunds will no longer be available. Exceptions apply.

I cancel your commission or am unable to complete it for whatever reason. Exceptions apply.

more than two months have passed since a payment has been made, and the commission has not progressed.

Finished artworks are not subject to refund under any circumstance.

Unless otherwise specified by the artist, commissioned art is for PERSONAL USE only.

To properly credit me, you must either include my twitter handle, instagram handle, or artstation.

My work may not be:

used for purposes involving AI, NFTs, or any other crypto-based platforms.

used for commercial purposes without asking, receiving explicit permission, and discussing payment options beforehand.

reproduced, changed, modified, or altered in any way (with the exception of changing the size).

The client may not:

take credit for any of my work, nor claim it as their own.

remove or crop out any watermarks, trademarks, signatures, logos, and/or otherwise distinguishing features within an artwork.

use/post the artwork in a misleading or deceptive way, especially to obscure or hide credit.

use any of the work as part of a trademark, design, brand name, and other similar things without first obtaining explicit permission.

distribute or give the artwork to others to use for commercial purposes unless permission was granted.

The client can:

share and post the work on social media and other platforms as long as the artist is credited.

use the artwork for a physical end product for PERSONAL USE only, unless otherwise specified by the artist.

If a chargeback is issued, or the commission is cancelled because the client was extremely rude or unpleasant, the client forfeits all rights to my artwork. I will have full rights to reuse and resell the artwork in that case.
