By purchasing my artwork and services, you acknowledge that you have read, understood, and agreed to all of the following terms and conditions.
✧ I [the artist] reserve the right to: a. post, show, and display any and all images related to the commissioned work including but not limited to WIPs (work in progresses), sketches, revisions, and the finished artworks themselves. Exceptions may be made, but not guaranteed, at the request of the client. b. refuse any commission request. c. cancel a project at any time, especially if any of my terms are violated. d. place anyone on a blacklist.✧ You, the client, may not: a. use my work for purposes involving AI, NFTs, or any other crypto-based platforms. b. use my work for commercial purposes unless you have asked and paid for a commercial license that I have agreed to give you. c. take credit for any of my work, nor claim it as your own. d. remove or crop out any watermarks, trademarks, signatures, logos, and/or otherwise distinguishing features within an artwork. e. use/post the artwork in a misleading or deceptive way. f. use/post the artwork without properly crediting me. g. distribute or give the artwork to a third party to use for a commercial purpose without a commercial license. h. modify or alter my artwork in any way outside of small edits such as changing the scale, size, contrast, and transparency.✧ All purchases you make from me are for digital artwork and/or intellectual property. Nothing is intended to be physically mailed nor shipped.✧ You are responsible for communicating any specifications you need, including, but not limited to the dimensions and resolution of the file.✧ You are may provide input, feedback, and request changes at any time within reason. Changes may not always be possible.✧ No major changes beyond what’s reasonable shall be made without additional fees. These fees will vary in cost depending on the amount of work needed to redo/change the artwork.✧ Unless there is a deadline, commissions may take longer than the estimated time provided on the invoice to complete.✧ Under no circumstances are chargebacks tolerated, and you agree to not attempt one. a. If a chargeback is issued, or the commission is cancelled, the client forfeits all rights to my artwork. I will have full rights to reuse and resell the artwork in that case.✧ If you are extremely rude and/or unpleasant at any point during the process, I have the right to cancel the commission immediately.✧ The finished artwork will be sent through email or WeTransfer for larger files.✧ To properly credit me, you must either include my twitter handle, instagram handle, or artstation.
✧ The client is responsible for payment conversions. If you use another currency, please make sure to pay the correct amount.✧ Commissions are priced (in CAD) on a commission-to-commission basis, and prices will vary depending on the project. Please feel free to ask me about the price for your specific project, even if you aren’t committed to commissioning me.✧ I only accept payments through paypal, and clients must provide their email in order to receive an invoice.✧ Payments are made 100% upfront for a commission, and I will not begin working until I have received the agreed sum.✧ Please do not send any kind of payment until I have confirmed that I can accept your commission and have asked to receive the agreed sum.
✧ Full refunds are available if: a. I am in the process of doing rough sketches. When the work goes beyond that point, refunds will no longer be available. If there are a large number of sketches, refunds will only be available during the first few. Regardless, I will notify you, the client, of the cutoff point. Exceptions apply. b. I cancel your commission or am unable to complete it for whatever reason.✧ Finished artworks are not subject to refund under any circumstance.
✧ You, the client, are responsible for communicating any wishes for your commission to remain private at the beginning of the process. Otherwise, WIPs and sketches alike may be shown to the public during the process. a. There is no additional cost to this provided that the privacy ends upon completion of the commission.✧ If you wish for me to delay posting the final artwork, I may charge a fee if I deem fit.✧ If you wish for the artwork to never be posted, I will charge a fee as I see fit.
✧ I retain all copyright over my work, including the right to reproduce and publish the work for self-promotional purposes.✧ I reserve the right to sign/watermark my work.
SEE LICENSING FOR USAGE RIGHTS
✧ Unless a commercial license is purchased, all commissions fall under a personal use license and only have personal usage rights.✧ The following is considered personal use: a. Sharing and posting the work on social media and other platforms. However, you, the client, must properly credit me. b. Using the artwork to make a physical end product for yourself only. c. Creating derivatives based on my work for a non-commercial purpose. The resulting work, no matter how far removed, must not be used commercially.
✧ If the commissioned work is intended for commercial use, you, the client, must ask and pay for a commercial license to have commercial use rights. If royalties are applicable, that also needs to be discussed beforehand.✧ You must purchase a Commercial Use License for each individual project. The license does not cover any future works made by me, commissioned by you.✧ Licensing fees will be determined as I see fit, but at a baseline, expect to see at least an additional a. 100% cost for illustrations to be used in a digital format (Website banners/backgrounds, starting soon screens, app icons, promotional posts, etc) b. 150% cost for illustrations to be used in a physical format where the illustration is NOT the main selling point (business cards, packaging, book illustrations, etc). c. 200% cost for illustrations to be used in a physical format where the illustration IS the main selling point (mugs, t-shirts, stickers, pins, posters, etc) d. 200% cost for the right to commercially use my designs and concepts. This grants you permission to use my designs and concepts for commercial purposes. Note that this does NOT mean you own the rights to the design. I retain all copyright over my work. e. 250% cost for book covers.✧ The following cases are considered commercial use/purposes: a. Reproducing and selling the artwork, publicly or privately. b. Creating any derivatives based of the work, no matter how far removed, to profit off of. c. Receiving profit from a medium/platform where you have posted my artwork, (eg. Patreon, YouTube, Twitch, Kick, personal sites, business cards, merchandise, etc).
