Terms of Service

I [the artist] reserve the right to:

post, show, and display any and all images related to the commissioned work including but not limited to WIPs (work in progresses), sketches, revisions, and the finished artworks themselves. Exceptions may be made, but not guaranteed, at the request of the client.

refuse any commission request.

cancel a project at any time.

refuse service and/or cancel a commission if any of my terms are violated.

All purchases are for digital goods and no physical items will be mailed nor shipped.

Typically, I work at 300 DPI, but the client is responsible for the file specifications, such as the dimensions and resolution of the image. Otherwise, we can work something out together.

The client may provide input, feedback, and request changes at any time within reason.

Major changes can only be made during the sketching phase. Once the client approves of the sketches, no further changes to the composition/pose/design may be made without additional fees. These fees will vary in cost depending on the amount of work needed to redo/change the drawing.

I have 3 slots open and will work on the commissions based on the order of receiving them. I will not begin the next commission until I finish the ones at the front of the queue.

Deadlines

Deadlines are acceptable as long as I am notified before payment. Otherwise, time spent on each commission, from when I begin working on them, will vary depending on complexity. May range from 2 weeks to 2 months.

Deadlines at least 2 weeks from the time of payment do not incur any extra costs unless it is a big project or there is a lot of work.

If the deadline is less than 2 weeks from the time of payment, there will be a minimum charge of 50$. It may cost even more depending on how tight the deadline is.

Under no circumstances are chargebacks allowed, and you agree to not attempt one. Chargebacks are not tolerated.

If you are extremely rude and/or unpleasant at any point during the process, I have the right to discontinue the commission without providing a refund.

File transfer for the images will be made through WeTransfer, and you will receive a link to download them through email. I do give away psds.

All prices are listed in CAD.

The client is responsible for payment conversions. If you use another currency, please make sure to pay the correct amount.

I only accept payments through paypal, and clients must provide their email in order to receive an invoice. Please DO NOT include an address, and pay through goods and services (not family and friends if applicable). At the moment, I am only accepting payments directly into my PayPal account as the invoice feature is not currently available to me. You will, however, still receive an invoice.

Payments are made 100% upfront and I will not begin working until I have received them.

Please do not send any kind of payment until I have confirmed that I can accept your commission and have asked to receive the agreed sum.

Prices may vary depending on, but not limited to, the difficulty, complexity, scale, and scope of the commission.

If the commissioned work is intended for commercial use/promotional purposes or is used to make money in other ways, I will charge 300% the original price.

Refunds may be given if:

I am still working on the sketches. When the work goes beyond that point, refunds will no longer be available. Exceptions apply.

I cancel your commission or am unable to complete it for whatever reason. Exceptions apply.

more than two months have passed since a payment has been made, and the commission is still yet to be finished (unless otherwise discussed).

Finished artworks are not subject to refund under any circumstance.

Unless otherwise specified by the artist, commissioned art is for PERSONAL USE only.

To properly credit me, you must either include my twitter handle, instagram handle, or artstation.

My work may not be:

used for purposes involving AI, NFTs, or any other crypto-based platforms.

used for commercial purposes without asking, receiving explicit permission, and paying the additional fees.

reproduced, changed, modified, or altered in any way (with the exception of changing the scale).

The client may not:

take credit for any of my work, nor are you able to claim it as your own.

remove or crop out any watermarks, trademarks, signatures, logos, and/or otherwise distinguishing features within an artwork.

use/post the artwork in a misleading or deceptive way, especially to obscure or hide credit.

use any of the work as part of a trademark, design, brand name, and other similar things without first obtaining explicit permission from the artist.

use the artwork for digital sales under any circumstance.

distribute or give the artwork to others.

upload the artwork to an image/media distributing website or stock photo website.

The client can:

share and post the work on social media and other platforms as long as the artist is credited.

use the artwork for a physical end product for PERSONAL USE only, unless otherwise specified by the artist.

If a chargeback is issued, or the commission is cancelled because the client was extremely rude or unpleasant, the client forfeits all rights to my artwork and is blacklisted. I will have full rights to reuse and resell the artwork in that case.
